The Editorial Board of the new AIDA Europe Research Series on Insurance Law and Regulation hereby issues an invitation for the submission of academic papers that examine the impact of and interplay between human rights and insurance.
National, supranational and international legal instruments regulating the taking-up and pursuit of the business of insurance, insurance distribution and the insurance contract often refer to or impact on human or fundamental rights. Courts are often faced with the sometimes seemingly impossible task of reconciling the principles and values stemming from the human rights protection and the insurance business mindsets. In some cases, such as that of discrimination in insurance, this discussion has been going on for decades. New issues have more recently emerged or should be revisited in light of recent developments, such as those stemming from technologic innovations (‘InsurTech’). We welcome theoretical, empirical and policy-oriented papers. We invite legal academics (including Ph.D. students) and legal practitioners to submit their manuscripts on topics exploring particular aspects of the impact of and interplay between specific human rights and insurance as well as papers which carry out wider analyses which may lead to a more systematic understanding of the interactions between the two fields of law. Papers can approach the issues from a national, transnational, international or comparative perspective. Although the series has a predominant legal focus, a multidisciplinary approach is welcome. Eligible topics include, without limitation: - insurance and discrimination, covering one or more classifications; – mandatory insurance, general liberty and the harm principle; – insurance and the right to privacy/ cyber risks/ data protection; – health insurance and the right to health care; – insuring driverless vehicles, programming life-and-death decisions and the inviolable right to life. SELECTED PAPERS will be published in a book edited by Margarida Lima Rego, Associate professor (NOVA University Lisbon, Portugal), and Birgit Kuschke, Associate Professor (University of Pretoria, South Africa). The publisher of this book, and of the series, is Springer. PAPER SUBMISSION INSTRUCTIONS: All abstracts and papers should be in English. The final paper/article is limited to 20,000 words (including footnotes). PAPER SUBMISSION PROCEDURE: The deadline date to submit an Abstract of 1-2 pages is 20/09/2018. The deadline date for the notice of acceptance is 10/10/2018. The deadline date to submit the final paper is 30/06/2019.
